Mow, When I go into an ER, Hospital, clinic, or my doctors office I expect t9o be treated by someone who knows what the hell they are doing. And if not to have a trainer that knows helping them so things like this do not happen. If there is neglect involved that causes pain and suffering the person injured is do coverage along with compensation for pain and suffering. Thats how I see it. OK, so this isn't just about the medical bill coverage then. That's what my question was. Outside of that, when you start talking neglect, which i completely agree with your point, I never thought it was automatic that an insurance company just paid it out. I thought there was a legal process involved to get a payout for pain and suffering due to neglect.

The complaint was they put the IV needle into the big nerve at the elbow, that is after she tried the back of the hand and the inside of the wrist, she left the band on all the time. At this time I said get some else to try putting the IV in which they did and were sucessful. I did get a lawyer for the pain and of use of my rt arm and hand. Remeber I am 5 days out of the hosp after having a valve replace in my heart and my INR is over 6 (blood to thin) . After 1 week they checked INR and its a 4.5 still to thin, 2 week I am complaing about the PAIN in the rt arm to doctor, 3 week I am commplaining again to a doctor about the Pain. The 4 week I went to a nerve doctor and she put down I was have NUMBNESS and TINGLE in my right arm in stead PAIN. The reson they said I have no claim WORDS, PAIN, NUMBNESS and TINGLE.
Med-care and Tri-care want the money back they paid out if I should get a settelment. The lawyer guess it would cost $40,000 to go to court.
Bear I now am a left handed typer one finger,it took almost an hour to type this, I hope this clear so question up.

All this talk about legal action is getting you nowhere with getting the nerve problem fixed so you can use your right arm without pain and tingling. Somewhere in the country is a doc who can fix it and it's Tricare/Medicare job to get you there, regardless of how, when and why the problem was caused. There has been a lot of medical progress with nerve regeneration especially with wounded vets returning from the Desert. The "squeaky wheel get the grease". Since you can't type very well with the injury, get Signe to write your words or look for a college kid to help you compose an appeal. Keep us posted on how your are doing. We all want to be helpful but are not real sure how to do it. Another resource might be Bob Kwiecinski who is heading up the F-106 Reunion. Just on Bret Baier Special Report Fox News. Over 900,000 vets are waiting an average of 9 months for a response to disability claims.
That just plain sucks! Thanks a bunch to Obama Sequestration that backlog will probably get worse.
